We strive to keep our fees reasonable and fair. We may agree to perform certain services for a flat rate. The services most conducive to a flat rate fee agreement are: Estate Planning, Bankruptcy, Business Formation, and Real Estate Sale Agreements.
Upon the firm's receipt of all or any portion of a flat
fee, the funds are immediately the property of the firm
and will not be placed in a trust account. The
fact that you have paid your flat fee in advance does
not affect your right to terminate the client-lawyer
relationship. In the event our relationship is
terminated before the agreed upon flat fee legal
services have been completed, you may or may not have a
right to a refund of a portion of the fee.
We may also agree to accept an
availability retainer. The availability retainer
is paid to secure the firm's availability. The
firm will be additionally and separately compensated on
the basis of either hourly services or a flat fee for
any actual work performed. The written fee
agreement will set forth a time period or purpose of the
firm's availability in exchange for the availability
retainer. Any availability retainer will be
immediately the property of the firm and will not be
placed in a trust account.
If not agreed otherwise,
the basis for determining our fee will be our hourly
rates and costs. Nothing herein shall amend or
modify our written fee agreement with you, our client,
so please read your fee agreement carefully.
Our attorneys' current hourly billing rates are:
Kenneth A. Berger (KAB) $220/hr
Any Other Attorneys $220/hr
Our Paralegals' current hourly billing rates are:
in-house paralegals $110/hr
other assigned paralegal/non-lawyer staff $110/hr
The fee rates and other fee information shown here is
general in nature. Please refer to your actual fee
agreement for the most accurate and up to date terms.
Rates may be increased annually on an incremental basis, without notice. Minimum billing increment .1 hr at principal attorney’s rate.
Terms of payment for services will be: due upon receipt of invoice, unless stated otherwise in
your fee agreement. An advanced fee and cost deposit is
required in most cases. A trial or arbitration
deposit is required in many cases.
Costs such as process service, filing fees, witness fees, court reporter fees, investigation, travel, accommodations, parking, telephone long distance, photocopies, and facsimile charges are
payable by the client. Such costs must be paid in addition to any flat rate
or hourly services incurred. Billing rates for these costs are available upon request
or set forth in your written fee agreement. Past due accounts will be charged interest at 12% per annum $5.00 per month minimum. In addition to interest, Client agrees to pay reasonable attorney's fees, and collections costs should legal or collection action be necessary to collect any money owed to Kenneth A. Berger. PLLC. Venue in any legal dispute shall be Snohomish County, Washington State.
